August 12, 2008: Court document 252 by John Murphy (PDF, 40 KB) - "Defendant John Graham seeks an order from the Court requiring the government to provide discovery regarding three specific matters, all of which are material to the presentation of his defense, have exculpatory or impeachment value, and are requests for information already within the government’s possession. 1) Documentation of payments made to informants Chapman and Nichols. 2) Payment demand letters (from Sarah Chapman). 3) February 18, 1976 FBI report regarding siting of Anna Mae Pictou Aquash was seen in Allen, South Dakota on February 12, 1976.

The Extration of John Graham to the US on December 6, 2007
On December 6, 2007 at 7:30 a.m. Vancouver time two guards came into John Graham’s cell at North Fraser Pre-trial Center in Port Coquitlam, British Columbia. John was aware of the time as he was waiting to use the phone at 8 a.m. The guards told him to pack his things, he was being moved. John was put in leg irons and hand cuffs. This was 15 minutes before the decsion by the Supreme Court of Canada to extradite John was made public in Ottawa.
John asked the quards where he was being taken but they refused to tell him. John said he wanted to call his lawyer but they wouldn’t let him. They said “booking will know where you are going.” “Booking” said he was being taken to the Surrey, British Columbia Pre-trial Centre, located only a few minute drive from the Canada/US border. Once again he asked to be able to call his lawyer and was refused. John arrived at the Surrey Pre-trial Centre about 9 a.m. where he was taken into the underground parkade. Two RCMP officers beside a black SUV told him to get in. John asked the officers where they were taking him and told them he wanted to call his lawyer. The officers would not say where they were taking him nor let him call his lawyer, and only said “don't make trouble.” The officers drove at high speed the short distance to the Canada/US border with their lights flashing and siren on, and the traffic was stopped. John was rushed across the border to the US. The US sheriffs informed John that they had been given instructions to pick him up at 4 a.m., about six hours before the decision was made public by the Supreme Court of Canada.
John's rights were once again severely violated. He was denied the right for a final appeal to the Canadian Minister of Justice and should have been allowed to call his lawyer.
The Canadian government still has obligations towards John. Chuck Strahl, Canadian Minister of Indian Affairs and Northern Development has a duty to make sure John has a fair trial and that the trial is closely monitored by Canadian officials. Letters should be written urging Minister Strahl fulfill his duties. Copies should be sent to his opposition counterpart Indian Affairs critic Anita Neville. Their addresses are below.
